Patient Consent for Telehealth Services

To meet the new requirements set forth in SB-184 Health (2021-2022), the Department of Health Care services (DHCS) released model telehealth patient consent language (below) that providers may incorporate into to their existing consent forms or communications. The draft model language was informed by key components of the requirements in SB 184, including:
- Right to in-person services
- Voluntary nature of consent
- Availability of transportation to access in-person services when other available resources have been reasonably exhausted
- Limitations/risks of receiving services via telehealth, if applicable
- Research and review of telehealth consent language used by other states and health care organizations
Providers are not required to use DHCS model language but rather can be utilized as a resource.
